Diplomatic passports are official state travel documents issued under Kenyan law. They form part of Kenya’s broader diplomatic and foreign service framework and are issued only in the circumstances prescribed by legislation and governmental authority.
A diplomatic passport does not, by itself, confer diplomatic status or diplomatic immunity. Those arise through official appointment, accreditation and the applicable rules of international law.

Legal Framework
The issuance of diplomatic passports in Kenya is governed principally by the Kenya Citizenship and Immigration Act, 2011 together with the Kenya Citizenship and Immigration Regulations, 2012, including the Third Schedule identifying categories of persons ordinarily entitled to diplomatic passports.
Kenya’s legal framework specifies a number of constitutional offices, senior governmental positions and members of the diplomatic service who may ordinarily qualify for diplomatic passports.
The Regulations also provide limited statutory discretion permitting the Cabinet Secretary to authorise the issuance of a diplomatic passport in circumstances provided for under Kenyan law.
Issuing Authority
Diplomatic passports are issued through the Directorate of Immigration Services in accordance with Kenyan law and administrative procedures.
Applications are processed through the Government of Kenya’s passport system. Eligibility, however, is determined by the statutory framework governing diplomatic passports rather than by the existence of a public application process.
Kenya’s Ministry of Foreign and Diaspora Affairs administers the country’s diplomatic service and international representation, while passport issuance remains an immigration function.
Who May Receive A Diplomatic Passport?
Unlike many jurisdictions, Kenya’s diplomatic passport framework identifies a detailed list of offices whose holders are ordinarily entitled to receive diplomatic passports.
The Third Schedule to the Kenya Citizenship and Immigration Regulations includes, amongst others:
- The President and members of the President’s immediate family.
- The Deputy President and members of the Deputy President’s immediate family.
- Cabinet Secretaries, Principal Secretaries and the Secretary to the Cabinet.
- The Speakers of the National Assembly and the Senate.
- Senior judicial and constitutional office holders.
- Senior officers of the Kenya Defence Forces, National Intelligence Service and National Police Service.
- County Governors.
- Former Presidents, Prime Ministers and Vice Presidents.
- Members of Kenya’s diplomatic service together with qualifying spouses and dependent children.
Separate legislation also extends diplomatic passport entitlement to Members of Parliament, members of the Parliamentary Service Commission, the Clerks of Parliament and certain accompanying spouses.
Kenya’s legal framework further provides limited statutory discretion enabling the Cabinet Secretary to authorise the issuance of a diplomatic passport in circumstances permitted by law. This discretion forms part of Kenya’s statutory framework and should not be interpreted as creating a public application programme.
Kenya Diplomatic Passports And Diplomatic Status
Under Kenyan law, possession of a diplomatic passport does not, by itself, create diplomatic status or diplomatic immunity.
Diplomatic status ordinarily arises through official appointment, accreditation and the performance of recognised diplomatic functions on behalf of the Republic of Kenya rather than through possession of the passport alone.
Accordingly, the legal rights, privileges and immunities associated with Kenyan diplomatic appointments depend upon both the nature of the appointment and the applicable rules of international law.

Kenya Diplomatic Passports And Honorary Consuls
Kenya appoints honorary consuls as part of its international representation, particularly in jurisdictions where permanent diplomatic representation may not be maintained.
Honorary consuls are recognised within Kenya’s diplomatic framework. However, they are not amongst the statutory categories ordinarily entitled to diplomatic passports under the published Third Schedule. Any entitlement would depend upon the applicable legal framework rather than honorary consul status alone.
